1. Acceptance of Terms

By downloading, installing, or using the BuildUp mobile application (“App”) and any related services, you (“User,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

BuildUp is a football performance analytics platform that provides:

• Video-based match analysis and performance breakdowns

• AI-powered coaching insights through Buildup Coach

• Training session and wellness logging

• Social features including Reels and public profile sharing

• Match Breakdown credits and subscription plans

• Referral and affiliate programs

3. Eligibility

You must be at least 13 years old to use this App. If you are under 18, you confirm that you have permission from a parent or legal guardian to use this service.

4. Account Registration

4.1 You must provide accurate and complete information when creating an account.

4.2 You are responsible for maintaining the security of your account credentials.

4.3 You must be the legal owner or have proper authorization to upload content (videos, match data) to the App.

4.4 You agree to notify us immediately of any unauthorized access or security breach.

5. User Content

5.1 Your Content: You retain ownership of videos, data, and content you upload to the App (“User Content”).

5.2 License Grant: By uploading User Content, you grant BuildUp a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content for the purpose of providing our services.

5.3 Content Restrictions: You agree not to upload content that:

• Violates any third-party intellectual property rights

• Contains harmful, abusive, or illegal material

• Is false, misleading, or defamatory

• Infringes on privacy or publicity rights of others

5.4 Monitoring: We reserve the right to review, moderate, or remove content that violates these Terms.

6. Match Submissions and Analysis

6.1 When you submit a match for breakdown you authorize our video analysts to access and review your submitted video. Analysis turnaround time is up to 48 hours from submission. Refunds are only available as Bubuck credits if a submission is rejected.

6.2 You confirm you have all necessary rights to share the match video, including consent from any visible individuals.

7. AI Coach (Buildup Coach)

7.1 The AI Coach provides performance insights and recommendations based on your data.

7.2 AI-generated content is for informational purposes only and does not constitute professional coaching or medical advice.

7.3 You should consult qualified professionals for specific coaching or medical guidance.

8. Public Profile and Social Features

8.1 Public Profile: You may optionally make your profile public via a shareable link. This exposes your performance data, statistics, and video highlights to anyone with the link.

8.2 Reels: Content posted to Reels is publicly visible. You can delete your reels at any time.

8.3 You are solely responsible for any content you make public.

9. Payments and Credits

9.1 Match Breakdown Credits (Bubuck): Credits are non-refundable. Unused credits do not expire but cannot be transferred.

9.2 Subscriptions: Subscription plans renew automatically unless cancelled. You can cancel at any time through your account settings.

9.3 Pricing: All prices are in USD and subject to change with notice.

9.4 Payments are processed securely through Stripe. By purchasing, you agree to Stripe’s terms of service.

10. Referral Program

10.1 You may participate in our affiliate program by sharing your referral code.

10.2 Commissions are earned on purchases made by referred users who sign up using your code.

10.3 We reserve the right to modify, suspend, or terminate the referral program at any time.

10.4 Fraudulent referrals will be voided.

11. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose

• Attempt to hack, reverse engineer, or interfere with the App’s functionality

• Create multiple accounts to abuse referral or credit systems

• Harass, threaten, or impersonate other users

• Use automated tools to access the App without authorization

12. Intellectual Property

12.1 The App, including all design, code, graphics, logos, and branding, is owned by BuildUp and protected by intellectual property laws.

12.2 You may not copy, modify, distribute, or create derivative works from any part of the App without our written permission.

13. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES.

15. Indemnification

You agree to indemnify, defend, and hold harmless BuildUp and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your User Content, violation of these Terms, or illegal conduct.

16. Termination

16.1 We may suspend or terminate your account at any time for violation of these Terms.

16.2 You may delete your account at any time through the App settings.

16.3 Upon termination, you lose access to your account, data, and any purchased credits (unless otherwise required by law).

17. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the App. Your continued use of the App after changes constitutes acceptance of the new Terms.

18. Governing Law

These Terms shall be governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

19. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to resolve through good-faith negotiation. If unresolved within 30 days, disputes may be submitted to binding arbitration under Florida law.
